Debt Free Weirdos

Its Weird to Be Debt Free - Start Being Weird Today!

Hi All,

I have been making re-payment offers to my creditors and thankfully 99% have accepted and I have been making my re-payments successfully, however one creditor will not budge even though I have sent my financial statement, copy of my earnings etc. I am still sending my minimum payment offer to them and they are taking it, so surely they can not continue to refuse the offer and send threatening letters, when infact they are taking the money I am sending, but I am still getting constant letters to say they will take me to court etc if I do not increase my offer which is not physically possible, any advice?

That's a tough one! I've always heard that creditors will work with you and be glad to do that so I'm not sure how I'd handle something like this stubborn place. Is it possible that maybe one or two of the other places would take even less so you can get the nasty one off of your plate?

See this is the thing and though I am aware that if they were to proceed with court action they wouldnt get very far because I am making an offer and even till today still paying them so as I am not refusing they wouldnt really have a leg to stand on in that sense, but its frustrating because I get constant letters from them. I will be trying to increase the payments but at this time not possible, the fact that they are crediting the minimum amount to my debt in my eyes is acceptance. Some can be real pains (to put it politely :D )

I tend to see it the same way you do... if they're taking the money and crediting it to your account, it sure doesn't seem as if they could possibly get away with harassing you with threats. I'd think they would need to send your check BACK and say "this is not acceptable" for them to have any legal ground to stand on.
